WILLIAMSPORT - A civil rights lawsuit filed in March by a Kulpmont woman against the borough, its police chief and department and several current and former members of Kulpmont Borough Council has been dismissed.
In an order filed Wednesday by U.S. District Judge Christopher C. Conner, the case filed by Cheryll Hornberger, of 611 Chestnut St., Kulpmont, was dismissed after legal counsel reported the suit had been settled.
"This is the first I'm hearing about it, but I am glad that it's all over," said Kulpmont Police Chief Richard L. Wilson III Wednesday after being told about the dismissal.
Wilson was named as a defendant both personally and in his capacity as police chief, along with the borough and its police department, Mayor Myron Turlis, current borough council members Bruno R. Varano, Clarence Deitrick, Philip Scicchitano and Joseph A Winhofer, and former council members James Wisloski, Michael V. Fantanarosa and Raymond D. Kraynak Jr.
Hornberger filed the suit in March against Kulpmont and its representatives following a January 2011 incident on Chestnut Street when Wilson arrested Hornberger for littering when a parking citation he allegedly tried to throw into her vehicle fell to the ground.
She claimed Wilson exposed her breasts while he searched her for weapons.
She claimed Wilson took her to the police station where he shackled her to a bench for 2 1/2 hours and charged her with violating the borough's parking ordinance, littering and disorderly conduct.
She was acquitted of the citations in April 2011, but said Wilson continued to harass her following the hearing.
Wilson said Wednesday he hasn't had any contact with Hornberger "in quite some time," and that things were relatively calm.
Terms of the settlement was not released in court documents found online.
Attempts to reach Hornberger were unsuccessful.
