SHAMOKIN - The following hearings took place Tuesday before Magisterial District Judge John Gembic III. Defendants ordered to appear for plea court April 28 at Northumberland County Courthouse, Sunbury, can plead guilty or no contest, or seek a trial by pleading not guilty.
n Charges of simple assault and reckless endangerment filed by Coal Township Patrolman Joshua Wynn against Robert Pesarchick, 44, of 2102 W. Independence St., Coal Township, were dismissed when his wife, Pam, the alleged victim, refused to testify against her husband.
Pesarchick was charged with allegedly pulling a gun and pointing it at his wife during a domestic dispute at 12:35 a.m. Jan. 28.
Pam Pesarchick took the witness stand and said she didn't want to have the case prosecuted against her husband. She said nobody threatened her about testifying. She said she and her husband are reconciling and attending counseling sessions.
Attorney David Marateck represented Robert Pesarchick.
n David E. Neidig, 46, of 1139 W. Pine St., waived to court multiple charges involving two incidents New Year's Day.
He is charged by Coal Township Patrolman Matthew Henrich with institutional vandalism, disorderly conduct, public drunkenness and resisting arrest.
According to a criminal complaint, township police were dispatched at 2:07 a.m. to the 900 block of Spruce Street for a suspicious person entering unlocked vehicles. Neidig was observed in the 1000 block when Henrich arrived, standing next to a vehicle with its owner's manual at his feet. Police allege he was highly intoxicated and when asked to stand on a sidewalk, urinated behind a parked vehicle.
He was taken home and told not to leave. Police later learned that he had left his home and was found in the 1100 block of Pine Street. He was yelling and cursing when taken into custody and struggled with officers as they attempted to place him into a patrol vehicle, the complaint states.
While in a police department holding cell, Neidig is accused of twice urinating on the floor and also ripping a bell from the wall just outside the cell.
n Melissa D. Brokenshire, 41, of 515 S. Ash St., Coal Township, waived to court charges of criminal attempt to commit aggravated assault and criminal attempt to commit simple assault relating to a Sept. 9 disturbance.
He is charged by Coal Township Deputy Police Chief Chris Williams with threatening to slash Williams with a razor after she cut herself with the same blade at her home.
n Amber Moyle, 35, of 295 State Route 2026, Coal Run, waived to court charges of simple assault, reckless endangerment, harassment, possessing instruments of crime and two counts of terroristic threats involving a Nov. 28 domestic disturbance.
Moyle is charged by Coal Township Patrolman David Sage with using a butcher-style knife to threaten Lenard Kreski Sr., 48, of the same address. Police said she threw the knife at him and also allegedly used a steak knife to threaten a 13-year-old male.
Kreski was assaulted by Moyle, police said, causing his lip to bleed and leaving a scratch on his nose.
n John F. Monterosso, 59, of 327 Centre St., Ashland, pleaded guilty to theft and was ordered to pay a $300 fine plus costs and placed on supervised probation for one year.
An additional charge of receiving stolen property were withdrawn.
Monterosso was charged by Coal Township Patrolman Jason Adams with stealing a coat owned by Eleanor Shulskie from a waiting room in the emergency room department at Geisinger-Shamokin Area Community Hospital on Dec. 29.
n Nicole A. Seidel, 26, of 905 W. Pine St., Coal Township, waived to court a charge of theft by deception filed by Coal Township Patrolman Matthew Henrich.
She is accused of defrauding a friend in a gift card sale in December.
n Kenneth K. Koons Jr., 18, of 103 S. Poplar St., Coal Township, and Emmanuel Temple, 18, of 614 N. Shamokin St., Apt. 506, Shamokin, waived to court charges of burglary, criminal trespass, criminal conspiracy, theft by unlawful taking, receiving stolen property, criminal attempt to commit theft and possessing instruments of crime.
They are charged by Coal Township Patrolman David Sage with entering the former Kmart department store along Route 61 on Jan. 19 and attempting to remove metal before being apprehending by police at the scene.
n Shane Hart, 25, of Dewart Street, Shamokin, pleaded guilty to theft by deception and was ordered to pay a $150 fine plus costs. Additional charges of forgery and criminal use of a communication facility were withdrawn.
Hart was charged by Coal Township Patrolman Joshua Wynn with paying for pizza from Dominos Pizza in Coal Township with a counterfeit $50 bill Jan. 13.
n Nicholas Villarreal, 45, of Shamokin, waived to court two felony counts of retail theft relating to two incidents at Walmart Supercenter along Route 61.
Villarreal is charged by Coal Township Patrolman Matthew Hashuga with stealing $916.92 worth of merchandise Jan. 19 and removing items valued at $337.84 Jan. 20.
n David DiSciullo, 27, of Atlas, pleaded guilty to retail theft and was ordered to pay a $100 fine plus costs and make restitution totaling $545.66, which is the amount of merchandise he was charged by Coal Township Patrolman Matthew Hashuga with stealing from Walmart on Dec. 23.
DiSciullo entered the plea via video because he is incarcerated at Chester County Prison on unrelated charges.
n Keith Nixon, 27, of Shamokin, waived to court two felony counts each of delivery of a controlled substance and possession with intent to deliver a controlled substance and felonies of criminal conspiracy and criminal use of a communication facility.
He is charged by Shamokin Cpl. Bryan Primerano with selling cocaine and marijuana to a confidential informant Oct. 11 in the city.
n Jonathan Shackelton, 29, of Shamokin, pleaded guilty to harassment and was ordered to pay a $200 fine plus costs. An additional charge of simple assault was withdrawn.
Shackelton was charged by Coal Township Patrolman Terry Ketchem with assaulting Debra Bendas, 42, of 1616 W. Arch St., Coal Township, at her residence Dec. 24.
