District Court: Gembic, Friday, March 22, 2013

SHAMOKIN - The following hearings took place Tuesday before Magisterial District Judge John Gembic III. Defendants ordered to appear for plea court April 29 in Northumberland County Courthouse, Sunbury, can plead guilty or no contest, or seek a trial by pleading not guilty.

n Michael P. McGuire Jr., 34, and his wife, Deann McGuire, 34, of 8 N. Second St., Shamokin, pleaded guilty to a misdemeanor of disorderly conduct and were each ordered to pay a $200 fine plus costs and placed on probation for six months.

Charges of simple assault and harassment were withdrawn.

The couple were charged by Shamokin Patrolman William Zalinski relating to a disturbance at their residence March 8.

n David P. Smith, 27, of 509 S. Diamond St., Shamokin, pleaded guilty to possession of drug paraphernalia and was ordered to pay a $300 fine plus costs.

The charge was filed by Shamokin Patrolman Jarrod Scandle in connection with a Feb. 2 incident at Smith's residence.

n Darvin L. Bohner, 58, of Gratz, waived to court a bad check charge filed by Trooper David Myers of state police at Stonington.

Bohner is accused of issuing a bad check in the amount of $967.78 to the Bed Barn along Route 61 in Stonington.

n Edward Miller III, 28, of Coal Township, waived to court charges of delivery of heroin, possession with intent to deliver heroin and criminal use of a communication facility involving a May 27, 2011, incident in Shamokin. Cpl. Bryan Primerano filed the charges.

Miller also waived to court a charge of possession of drug paraphernalia involving a July 4, 2011, incident at Walnut and Third streets in Shamokin. Primerano was the arresting officer.

n Donald Ponatoski, 26, of 1128 W. Gowen St., Coal Township, waived to court charges of theft by unlawful taking, receiving stolen property and criminal trespass.

He was charged by Trooper Samuel Edwards of state police at Stoningtin with stealing scrap metal valued at $1,370 from Schoolhouse Road in Shamokin Township on March 9.

n Katherine Bixler, 28, of 17 Walnut St., Mount Carmel, and Roslyn M. Nairns, 30, of 1011 W. Pine St., Coal Township, waived to court charges of simple assault, disorderly conduct and harassment relating to a Feb. 1 disturbance at Rescue Fire Company.

Police reported Bixler and Nairns assaulted a woman at the station's banquet hall.

n Albert J. Schweitzer Jr., 37, of 721 Center St., Tharptown, had charges of simple assault and harassment withdrawn against him.

He was charged by Shamokin Patrolman William J. Zalinski with striking his girlfriend, Katherine Bixler, on West Spruce Street on Feb. 1.

n Thomas J. Feudale, 47, of 545 Sixth St., rear apartment, Ranshaw, waived to court charges of making false alarms to public safety agencies and disorderly conduct.

Feudale was charged by Coal Township Patrolman Matthew Hashuga with making more than a dozen false calls to Northumberland County Communications Center between 1:50 and 4 a.m. March 9 from his apartment. Police said the calls involved claims that Puerto Rico was spying on him, complaints about the water company and a request for a phone number for the FBI. Police said Feudale also played music over his phone during the calls.
